Shipping times are estimates and not guaranteed. We are not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control. Risk of loss and title for items purchased pass to you upon delivery to the carrier.

7. Returns and Refunds

All sales final unless damaged. Items must be in original condition, unused, and in original packaging. Custom or personalized items are not eligible for return. Return shipping costs are the responsibility of the customer unless the item was defective or incorrectly shipped.

IN NO EVENT SHALL TEMPEST FURNITUR, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless Tempest Furnitur and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

15. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

16. Governing Law and Jurisdiction

These Terms shall be interpreted and governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Chesapeake, Virginia, and the parties hereby consent to personal jurisdiction and venue therein.

17. Dispute Resolution and Mandatory Mediation

MANDATORY MEDIATION: Before initiating any litigation, the parties agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms through binding mediation administered by a mutually agreed upon mediation service in Chesapeake, Virginia. Each party shall bear their own costs of mediation. If mediation is unsuccessful after sixty (60) days, either party may then proceed to litigation in the courts specified in Section 16.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

19. Waiver

No waiver by the Company of any term or condition set forth in Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under Terms shall not constitute a waiver of such right or provision.

20. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

21. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, or any other cause beyond our reasonable control.

22. Entire Agreement

These Terms constitute the entire agreement between you and Tempest Furnitur regarding the use of the Service, superseding any prior agreements between you and the Company relating to your use of the Service.
